ROOT III Burning in the City of Avon Burning in the City of Avon falls into multiple categories: 1) Open Burning- the burning of any materials wherein contaminates resulting from combustion are emitted directly into the air without passing through a stack or chimney. A) Requirements: Written permission from the Ohio EPA, Mayor, Safety Director, Chief of Police and the Fire Chief The Fire is located at a point no less than 1000' from any inhabited building riot located on the premises They are fueled with clean seasoned firewood, natural gas or equivalent, or any clean burning fuel with emissions that are equivalent to or lower than those created from the burning of seasoned firewood; They are not used for waste disposal purposes; They shall have a total fuel area of three feet or less in diameter and two feet or less in height. They must be attended until fully extinguished. B) Exception: Heating tar, welding, acetylene torches, highway safety flares, heating for warmth of outdoor workers and strikers, smudge pots and similar occupational needs. Bonfires, campfires and outdoor fireplaces and UL listed equipment, whether for cooking food for human consumption, pleasure, religious, ceremonial, warmth, recreational, or similar purposes, if the above conditions 3, 4, 5, & 6 are met and shall be of minimum sufficient size for their intended purpose, must remain a safe distance to structures and other combustibles and must be attended until fully extinguished. 2) Bonfires or campfires (Recreational Fires) used for ceremonial purposes that do not meet the requirements of paragraph B above- Written permission from the Ohio EPA, Mayor, Safety Director, Chief of Police and the Fire Chief. They are fueled with clean seasoned firewood, natural gas or equivalent, or any clean burning fuel with emissions that are equivalent to or lower than those created from the burning of seasoned firewood They are not be used for waste disposal purposes They have a total fuel area no greater than five feet in diameter by five feet in height and burn no longer than three hours Bonfires shall not be conducted within 50' of a structure or combustible material and conditions which would cause a fire to spread within 50' of a structure shall be eliminated prior to ignition. Campfires (recreational fires) shall not be conducted within 25' of a structure or combustible material and conditions which would cause a fire to spread within 25 'of a structure shall be eliminated prior to ignition They must be attended until fully extinguished 3) Disposal of agricultural waste generated on the premises- A) Requirements: Written permission from the Ohio EPA, Mayor, Safety Director, Chief of Police and the Fire Chief. The fire is set only when atmospheric conditions will readily dissipate contaminants The fire does not create a visibility hazard on the roadways, railroad tracks, or air fields The fire is located at a point on the premises no less than 1000' from any inhabited building not located on said premises The wastes are stacked and dried to provide the best practicable condition for efficient burning No materials are burned which contain rubber, grease, asphalt or liquid petroleum products. They must be attended until fully extinguished Sufficient extinguishment equipment that is of adequate size and capacity and is compatible to the material that is burning shall be present and functional at all times during all burns. The Avon Fire Department has a duty to investigate all complaints related to all categories of open burning. If conditions are found that create an immediate hazard such as excessive brand or smoke emission, improper fire location or site preparation or intoxicated, impaired or absent responsible parties, the Officer on scene shall confiscate the permission to burn paperwork (if applicable) and order the immediate extinguishment of the fire 10/29/08 |
